洪律师您好:请问因个人迟到遭到解雇是否应享有解雇金。
我看到菲律宾劳工法里说除了公司因经济原因可以免除解雇金之外,其他的都应该支付解雇金。
希望得到您的回复, :16:}:16:}:16:}:16:}楼主是要迟到多少次? 您一个月迟到多少次呢?
公司是否有明文规定关于迟到的条例? 我觉得个人原因迟到应该没有解雇金吧?公司辞退你才有好像
迟到几次就开除太过了,劳工法应该不支持,故须付解雇金。除非公司明文规定迟到次数但也要三次警告才能开除。

Hi, you have to give a memo to the subject employee citing his or her tardiness. There is no hard and fast rule. But after giving memo for 3 consecutive times that he was late, it will be a ground for dismissal.But usually, suspension without pay is the better penalty. Good luck!
